Recognizing the potential and advantages of natural landscapes in this area, on November 5, 2015 the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China signed an Agreement on cooperation in protecting and exploiting tourism resources within the Ban Gioc (Vietnam) - Detian (China) Scenic Area, which officially came into effect on June 16, 2016. The completion of the signing of the Agreement by the two countries has an important meaning in Vietnam-China relation, creating favorable conditions for economic, cultural and social development in the border areas between the two sides.

The median line located on the main flow of the Quay Son River is the main waterfall's boundary demarcation between Vietnam and China.

Ban Gioc - Detian Agreement includes 13 provisions on the scope of the scenic area, entry and exit of the landscape area, the protection, development, management, security and order assurance, border gate opening, etc. In general, the two sides agreed as follows: firstly, the two sides agreed to establish Ban Gioc - Detian waterfall scenic area and to cooperate to protect, and effectively and rationally develop tourism resources in this area; secondly, the protection and development of tourism resources in Ban Gioc - Detian Falls scenary must not affect the territorial sovereignty and national security of Vietnam and China, and comply with the relevant agreements between the two countries; thirdly, Vietnam is responsible for and applies the laws of the Socialist Republic of Vietnam to the part in the territory of Vietnam, and China is responsible for and applies the laws of the People's Republic of China to the part that belongs to Chinese territory; fourthly, all organizations and individuals are strictly prohibited from taking advantage of tourism activities within Ban Gioc - Detian waterfall scenic area to conduct illegal activities. Any violations must be dealt with equally before the law. In the territory of any law violation, the authorities of that party shall handle in accordance with the law of that country; fifthly, the two sides carry out the management in a closed form to the waterfall scenic area. The two sides agreed to further discuss the issue of simplifying immigration procedures and establishing travel routes to facilitate tourists to visit Ban Gioc - Detian waterfall scenic area.

Recognizing the importance of the Agreement and implementing the Prime Minister's direction in Decision No. 1806/QĐ-TTg dated November 14, 2017, approving the implementation plan of the Agreement, Cao Bang province has actively developed a plan to implement the Agreement; set up a Provincial Coordinating Committee, Standing Office to implement the Agreement and the Task Force. The province has also conducted many field surveys, talks, discussions with the Chinese side to agree on cooperation contents such as completing procedures to open the Ban Gioc (Vietnam) - Detian (China) border crossing at the landmark 834/1+30m toward the landmark 834, the scale and method of building border checkpoints, the plan to build border fences, transport connections at border crossings, the plan to manage visitors to the landscape, and the plan to manage tourism services on border rivers. The two sides agreed to jointly study the management plan with modern scientific and technological equipment, creating favorable conditions for visitors as well as experiencing different types of services in the area.

Ban Gioc Waterfall Festival 2019

In order to do well the cooperation in the field of state management and ensure safety for tourists, the two sides agreed to organize a one-year trial operation for visitors to the scenic area to gradually improve the effectiveness of the management before putting it into official operation. Currently, Cao Bang (Vietnam) and Guangxi Zhuang Autonomous Region (China) are completing the construction of border checkpoints for management forces. Cao Bang province has established Ban Gioc waterfall tourism management board to manage and collect tourist fees in accordance with Resolution No. 43/2019 / NQ-HDND dated December 11, 2019 of Cao Bang Provincial People's Council. After the situation of the Covid-19 epidemic has stabilized, the two sides will agree on the time for organizing the new border crossing opening ceremony and the trial operation for visitors to the scenic area of the two sides.
